Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("client," "you," or "your") and The Rhino Marketing ("Company," "we," "our," or "us"), concerning your access to and use of our website (therhinomarketing.com) and the marketing software, websites, CRM dashboards, and conversational AI services we deploy.

By signing up for our services or accessing our systems, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree, you are prohibited from using our services.

2. Scope of Services

We provide local marketing, search engine optimization (SEO), and custom database automation tools tailored for US trade contractors, including:

• •Custom website designs (ranging from 5 to 20 pages based on selected plan).
• •Wholesale reseller calendar scheduling and automated sales pipeline configurations (GoHighLevel systems).
• •24/7 Conversational AI chat widgets, auto review responders, and virtual voice receptionists (AI Buddy tiers).

3. Subscriptions, Fees & Cancellations

• •Monthly Billing: Our services are billed on a flat-rate monthly subscription model (e.g. $249/mo, $397/mo, $597/mo, $897/mo). Subscription payments are billed in advance on a recurring monthly cycle.
• •No Setup Fees: Our standard plans feature $0 setup fees and have no lock-in contracts.
• •Cancellation Policy: You may cancel your subscription at any time. To prevent your next billing cycle, cancellations must be requested in writing at least 7 days before your next billing date. Upon cancellation, access to your GoHighLevel sub-account, CRM portals, and host databases will terminate at the end of your paid cycle.

4. Plan Allowances & Fair Use

To maintain the integrity and fair use of our shared servers, each plan includes assigned monthly communication quotas:

• •LaunchPad / AI Spark: Includes 200 SMS and 1,000 automated emails per month.
• •ScaleUp / AI Accelerator: Includes 500 SMS and 5,000 automated emails per month.
• •MarketOwner / AI Titan: Includes 1,000 SMS and 10,000 automated emails per month. AI Titan includes an additional 100 AI Voice minutes.

Usage exceeding these included monthly allocations is passed through to the client at wholesale carrier rates (rounded to local SMS/email segments) with zero agency markup, charged directly to the client credit card on file.

5. Client Responsibilities

As a client, you agree to fulfill the following requirements necessary for service operations:

• •You must register and maintain your own website domain (~$10–15/year paid directly to Godaddy or Namecheap).
• •You must fund any paid traffic advertising campaigns (Google Ads, Meta Ads) directly to Google or Meta.
• •You must comply with US TCPA and carrier policies regarding A2P 10DLC SMS registration. You agree to provide valid tax/EIN details if needed to register your business brand for messaging compliance.

6. Intellectual Property & License

Once your website is fully paid and active, we grant you a perpetual, royalty-free license to use the custom website layout, branding logos, and content created on your behalf. Software tools, proprietary custom CRM workflow setups, and trained AI prompt configurations remain the intellectual property of The Rhino Marketing.

7. Limitation of Liability

In no event will The Rhino Marketing, our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages (including lost profits, lost leads, or carrier regulatory fines) arising from your use of our software, website mockups, or automated AI voice/SMS agents.

8. Governing Law

These Terms of Service and your use of our services are governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles. Any legal action arising under these terms shall be filed in the state or federal courts located in Houston, Harris County, Texas.
